Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using the Beam mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. User Accounts

You may need to create an account using "Sign in with Apple" to access certain features. You are responsible for maintaining the confidentiality of your account and for all activities that occur under it.

3. User Conduct and Content (EULA)

Beam allows users to post photos ("Beams") and view content from others. By using the App, you agree to the following rules regarding User Generated Content (UGC):

3.1. Prohibited Content

Strict No NSFW Policy: You may NOT post content that is pornographic, sexually explicit, or contains nudity. Beam has a zero-tolerance policy for such content.

You also agree NOT to post content that:

• Is illegal, abusive, defamatory, harassing, or threatening.
• Promotes hate speech, violence, or discrimination.
• Infringes on the intellectual property rights of others.
• Involves bullying or harassment of other users.

3.2. Content Moderation

We reserve the right to monitor, review, and remove any content that violates these Terms. We have the right to suspend or terminate accounts that violate these rules without notice.

3.3. Reporting and Blocking

Users can report inappropriate content or block other users directly within the App. We will review reported content within 24 hours and take appropriate action, including removing the content and ejecting the user who provided the offending content.

4. Intellectual Property

You retain ownership of the photos you post. However, by posting content, you grant Beam a non-exclusive, royalty-free license to display and distribute your content within the App to your subscribers.

5. Liability Disclaimer

The App is provided "as is" without warranties of any kind. Beam is not responsible for the content posted by users. We do not guarantee that the App will be error-free or uninterrupted.

6. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FCH Technology operates, without regard to its conflict of law provisions.
